to take out a loan question by Terry: What do I do when a “loan” company harasses me?
My mom and I took out a loan in July from a company called Cash Advance for $ 300. The loan was paid and everything was fine. Now a man from India named “Alex Rodriguez” is harassing my father at his job, hacking into the phone line, hacking into my mom’s email, saying my father owes $ 545 out of court, saying that he’ll take his paycheck if it’s not settled, threatening him, and worse, he knows ALL of the loan information, even the bank account number! I think it’s crap but my dad is scared that he’ll lose his paycheck to this strange “Alex”. How would they have all that information and How do I get them to stop harassing us? Is he fake? PLEASE HELP!!! 🙁

Next time they call the only thing to say is “I do not acknowledge this debt. Per the Fair Debt Collections Act I am demanding written proof of this debt be mailed to my home address within 30 days or your demands for payment shall be considered extortion. In addition you are to cease all phone communication with me or any members of my family, and all future communication may only take place in writing. Should you call again after I have told you to cease and desist all calls, I shall be pursuing harassment charges against you.”

Then write a letter to the company at their corporate address stating exactly the same thing – and send it certified mail and keep a copy of the letter and the delivery confirmation

If they call after you have sent that letter, then tell them “I am required to inform you that all calls to this number are being recorded as part of a law enforcement investigation. If you do not consent to having this call recorded, then you must immediately hang up” — that usually scares them off and stops them from calling

I would also call Cash Advance yourself and confirm that their records show that the loan was paid off. Let them know that you are being harassed by a collector after paying off the loan. It’s possible that their system was hacked and they don’t even know that scammers are contacting their customers

Your dad is in NO danger if he was not a co-signer on the loan. And even if he was, they would have to sue in small claims court and prove that you did not pay the loan in order to get a court judgment to garnish his or your wages. If you have proof the debt was paid off, then they have no case
